Professor Sean Tu Publishes New Research in New England Journal of Medicine

West Virginia College of Law professor S. Sean Tu published new scholarship in the New England Journal of Medicine. The article is titled "Clearing Dense Drug-Patent Thickets ". Professor Tu's co-authors are: Bernard Chao, University of Denver Sturm College of Law; Ryan Whalen, University of Hong Kong; and Aaron S. Kesselheim, Brigham and Women’s Hospital. The article was published online by the journal on November 27, 2024 and subsequently in print on December 12, 2024.

Professor Sean Tu Publishes Special Communication in JAMA

West Virginia University College of Law professor  S. Sean Tu recently published a new Special Communication in JAMA. The article is titled  "Differential Legal Protections for Biologics vs Small-Molecule Drugs in the US," and explores the premise that biologics require more time and resources to develop and have weaker patent protection, necessitating additional protections for manufacturers to recoup their development costs and generate adequate returns on investment.

Professor Tu co-authored with work with Olivier J. Wouters, London School of Economics and Political Science, Matthew Vogel, John F. Kennedy School of Government at Harvard University, William B. Feldman, Brigham and Women’s Hospital and Harvard Medical School; Reed F. Beall, Cumming School of Medicine at University of Calgary; and Aaron S. Kesselheim, also of Brigham and Women’s Hospital and Harvard Medical School. It was published online by the journal on November 24, 2024.

Professor Sean Tu Publishes New Research Letter in JAMA

West Virginia College of Law professor  S. Sean Tu recently published a new opinion piece in J AMA. The article, titled  "Characteristics of Academic Inventors on Government-Linked US Drug Patents" is co-authored by Professor Tu with Matthew J. Martin, MA, Sarah M.E. Gabriele, LLM, MBE, and Aaron S. Kesselheim, MD, JD, MPH, all affiliated with the Program on Regulation, Therapeutics, and Law at Brigham and Women’s Hospital. It was published online by the journal on November 21, 2024.

The article, titled  "Extent of Drug Patents With Terminal Disclaimers and Obviousness-Type Double Patenting Rejections," is co-authored by Professor Tu with Aaron S. Kesselheim, MD, JD, MPH, of the Program on Regulation, Therapeutics, and Law at Brigham and Women’s Hospital and Bernard Chao, JD of the University of Denver Sturm College of Law. It was published online by the journal on August 12, 2024.

The article discusses patent holders' responses to "obviousness-type double patenting rejections," the use of terminal disclaimers, and the impact on large portfolios of secondary patents or "patent thickets."

Professor Sean Tu Speaks on Panel, Prescription for Change: Reforming Patents to Lower Drug Costs

West Virginia University College of Law professor S. Sean Tu recently participated in a virtual panel discussion on patent reform and the affordability and accessibility of prescription drugs. The event was organized by the R Street Institute and held on July 24, 2024. Professor Tu was joined on the panel by Wayne Broug, R Street Institute, and Tahir Amin, Co-founder and CEO of Initiative for Medicines, Access, and Knowledge. The discussion was moderated by Canyon Brimhall, R Street Institute.
