Professor Anne Marie Lofaso Comments on Muldrow v. City of St. Louis, Missouri in PREVIEW of United States Supreme Court Cases

West Virginia University College of Law professor  Anne Marie Lofaso recently published in the ABA's PREVIEW of United States Supreme Court Cases. Professor Lofaso comments on an upcoming employment law case, Muldrow v. City of St. Louis, Missouri, Docket No. 22-193, to be heard in the October 2023 term. The article is titled "Does Title VII Prohibit Discrimination in Employment-Transfer Decisions Only if They Cause Materially Significant Disadvantages for Employees?" Professor Lofaso's contribution appears in volume 52, issue 3 of the journal, published in November 2023.

Case at a Glance:

Petitioner Jatonya Clayborn Muldrow, a sergeant for the St. Louis Police Department, was transferred to another unit within the department. Muldrow sued the City of St. Louis for making a discriminatory transfer decision in alleged violation of Title VII. This case presents the question of whether Title VII prohibits discriminatory transfer decisions absent a separate court determination that the decision caused Muldrow materially significant disadvantages.
